Hire Terms and Conditions
The below policies outline the obligations of theHirer. By booking through our website or/and signing the invoice and making payment, the Hirer is agreeing to the below terms and conditions.
Please ensure that you have read and understood these terms and conditions.
1. Agreement
1.1. The Eventurer Pty Ltd (we, us, our) agrees to provide the Equipment to The Hirer on a temporary basis (Hire) on the terms and conditions of hire set out below (Terms).
1.2. The Hirer agrees to accept the Hire of the Equipment from us on these Terms.
1.3. The Hirer has accepted these Terms if:
(a) the Hirer submits an online booking
(b) the Hirer pays us a Deposit or any Fees;
(c) the Hirer receives any Equipment from us; or
(d) the Hirer indicates by actions or writing that they accept these Terms.
1.4. Any person or representative that accepts these Terms on behalf of the Hirer warrants that they have the authority of the Hirer to enter into these Terms.
1.5. The parties agree that these Terms are governed by the laws of Victoria and submit to the exclusive jurisdiction of the courts of Victoria.
1.6. The Hirer agrees that all personal information collected under these Terms will be collected in accordance with our Privacy Policy.
2. Conditions of Hire
2.1. In consideration of the Hirer paying the Hire Fees in accordance with clause 5, we agree to Hire the Equipment to the Hirer for the Hire Period which is outlined in in clause 12 for the purpose of the Event at the Event Location as set out in the Booking.
2.2. The Hirer may request an extension to the Hire Period on payment of additional Hire Fees subject to our written consent.
2.3. At all times the Hirer acknowledges that the Equipment is owned by us.
2.4. The Hirer agrees to only use the Equipment in accordance with our instructions.
2.5. The Hirer acknowledges and agrees that it Hires the Equipment at its own risk.
2.6. The Hirer is responsible for the Equipment throughout the Hire Period and is liable for any theft, loss or damage caused to or by the Equipment during the Hire Period.
2.7. The Hirer agrees to protect and appropriately store the Equipment to avoid damage during the Hire Period.
2.8. The Hirer must notify us immediately if any Equipment is lost, damaged, broken or destroyed.
2.9. The Hirer must have the necessary liability insurance to cover the loss, damage, theft or injury caused by the Equipment throughout the Hire Period.
2.10.The Hirer acknowledges that a fee will be charged to all Bookings to account for fair wear and tear of the Equipment for the Hire Period (Fair Wear and Tear Fee).
2.11.The Hirer will stop using the Equipment if it becomes unsafe to use and will take all necessary steps to prevent any further damage.
3. Delivery & Collection
3.1. We offer Delivery Services of the Equipment to the Event Location for the Hirer in consideration for a Delivery Fee.
3.2. The Hirer is responsible for and must provide safe and proper access to the Event Location if it orders the Delivery Services. This includes notifying us of all timing, rules or restrictions for installation, the delivery and the Event Location.
3.3. The Hirer acknowledges and agrees that deliveries to unsealed or unmarked roads, additional carparking charges or any additional cost of the delivery that we incur must be paid by the Hirer to us on request.
3.4. The Hirer agrees not to remove any Equipment from the Event Location or change its installed position without our written consent.
3.5. The Delivery Services may be refused or not provided if the Hirer does not provide a safe and secure delivery location. If Delivery Services are attempted and unsuccessful due to the Hirer’s actions, the Hirer agrees to pay the Delivery Fee.
3.6. The Hirer can collect the Equipment from our warehouse directly on the Pickup Date and return the Equipment at the end of Hire Period if it does not want to use our Delivery Services.
4. Bookings
4.1. To secure a booking the Hirer must pay us the Deposit and provide us with the Hirer’s Credit Card. When the Hirer pays the Deposit and provides the Hirer’s Credit Card, the Quote is confirmed and the Equipment is reserved for the Hirer for the Hire Period (Booking).
4.2. The Hirer acknowledges and agrees that the Booking is not confirmed until they have paid the Deposit and provided the Hirer’s Credit Card to us.
4.3. If we are unable to meet our obligations under a Quote or Booking, we will notify the Hirer within 21 days of the date of the Quote or Booking and refund any Deposit or Hire Fees paid relating to that Booking.
4.4. Up to 7 days prior to the Event, the Hirer may request to change items of Equipment and amend the Booking. This request will only be approved at our sole discretion. If we agree to amend the Booking, the Hire Fees will be adjusted to reflect the update. You will incur a fee for actioning this request (Change Fee).
5. Payment Terms
5.1. We agree to provide the Hirer with an invoice for the Hire Fees (Invoice) on confirmation of the Booking.
5.2. The Hirer agrees to pay to us all Hire Fees for the Booking as set out below:
(a) Deposit on confirmation of Booking; and
(b) balance of Hire Fees (less the Deposit) no later than 21 days before the Hire Period.
5.3. We will not make the Equipment available to the Hirer on the Delivery Date or the Pickup Date if the Hire Fees for the Booking have not been paid in accordance with clause 5.2.
5.4. The Hirer authorises us to charge the Hirer’s Credit Card any amount payable pursuant to these Terms including Hire Fees if the Hirer has not paid the amount owing within 7 days of the due date.
5.5. The Hirer agrees that any discounts or rebates that we apply to the Invoice are only applicable to the fees associated with Equipment hire and no other fees payable under these Terms.
5.6. The Hirer agrees that if any discount or rebate has been applied to a Booking, the discount or rebate only applies if the Hirer pays the Invoice in accordance with clause 5.2.
5.7. Any Hire Fees not paid by the Hirer for more than 14 days from the due date may incur interest at a rate that isn’t more than 2% over the Cash Target Rate set by the Reserve Bank.
6. Cancellation
6.1. All Hire Fees, including the Deposit are non-refundable and payable if the Hirer cancels or reduces the volume of a Booking within 14 days or less of the Hire Period.
6.2. If a Booking is reduced or cancelled less than 21 days but more than 14 days before the Hire Period, the 50% deposit is non-refundable and a $100 admin fee will be taken out of the
6.3. The Deposit is not refundable if the Hirer cancels a Booking 21 days or less before the commencement of the Hire Period.
6.4. If a Booking is cancelled 22 days or more before the Hire Period, the Deposit is not refundable however we will refund the Hire Fees paid to us for the Booking.
7. PPSR
7.1. To protect our rights of ownership and possession of the Equipment, we may register our interest in the Equipment on the Personal Property Securities Register (PPSR) (Security Interest).
7.2. The Hirer consents to that registration and will comply with all necessary requirements to make the registration effective under the relevant laws. The Hirer waives any notice required under sections 95 (Notice of Removal of Accession), 130 (Notice of Disposal), 132(4) (Statement of Account), 135 (Notice of retention), 143 (Reinstatement of Security Agreement) and 157 (Notice of Registration) of the Personal
Property Securities Act 2009 (Cth).
7.3. If we need to activate the Security Interest, the Hirer must allow us entry into the Event Location to enable us to take possession of any Equipment.
8. Warranties and Indemnity
8.1. The Hirer warrants to us that during the Hire Period it has the required insurance policy to cover any loss, damage, theft or injury for the Equipment.
8.2. We provide no warranties for fitness for the purpose of the Equipment.
8.3. The Hirer indemnifies us and holds us harmless for any loss, damage or injury or damage caused to any third party, the Hirer, its employees, officers or agents, arising from any person’s use of, contact with or possession of the Equipment during the Hire Period. goods. If hire items are lost, stolen or damaged, The hirer authorises The Eventurer to deduct amount owing from the security bond to cover the
replacement cost. If the replacement cost exceeds the bond amount, the customer will be sent an invoice for the remaining replacement cost.
8.4 The hirer agrees to return all items in the original packaging, bubble wrap and company branded boxes. Failing to do so will incur a replacement fee that will be deducted from the bond.
8.5. The hirer agrees to return items in the condition they received them in. If Items are returned and require excessive cleaning, cleaning fees starting at $150 will be deducted from your bond. Cleaning fees do not apply if our candles are purchased and used.
8.6. The Hirer indemnifies us for any loss or damage incurred arising out of the Hirer’s breach of these Terms including without limitation payment of our legal costs, expenses or debt collectors’ fees.
8.7 The damage waiver is a standard fee in the hiring industry to cover minor damage to the stock. It does not cover loss or negligence resulting in the item having to be replaced or written off. Any damage or loss of hire items will be charged to client at full replacement cost. If our table linen is damaged, the full replacement cost will be charged. Confirmation of order accepts conditions of hire.
9. Limitation of liability
9.1. To the maximum extent permitted by law, we are not liable for any loss, damage or injury caused to any person, property, or location arising from the use or possession of the Equipment or these Terms during the Hire Period.
9.2. To the maximum extent permitted by law, our maximum liability to the Hirer under these Terms is limited to any Hire Fee paid to us by the Hirer for the relevant Booking.
10. Termination
10.1. Subject to the Hirer paying any fees applicable under clause 5 and 6, either party may terminate these Terms at any time by providing notice to the other party.
10.2. These Terms may be immediately terminated by any party upon written notice if either party becomes incapable of continuing by reason of death, bankruptcy, or insolvency (as defined by the Corporations Act).
10.3. Upon termination or expiry of these Terms all amounts owing by the Hirer to us become immediately due and payable to us.
11. Force Majeure
11.1. Neither party will be in breach of these Terms if a Force Majeure event occurs and that party is unable to perform its obligations under these Terms, provided the party gives the other party written notice giving full particulars of the Force Majeure and the Force Majeure is the sole reason it is unable to perform their obligations.
12. Hire duration
12.1 The description of durations are based on individual products and outline below:
12.2. 4 day hire, The Hirer agrees to be charged $40 per day for every day exceeding the4 days of hire. 4 day hire example: Thursday until Monday /Friday until Tuesday

13. Covid Policy
In the event that a sudden change in restrictions occurs prior to your event, a 12 month credit will be provided on the paid amount to reschedule your existing booking. As per our refund policy, no refunds are available on the booking fee deposit amount
which is 50% of the total invoice.
14. Definitions
14.1. In these Terms, unless indicated otherwise the following words have the meaning set out in this clause.
Delivery Date means the delivery date indicated on the Booking.
Delivery Services means delivering, installing and collecting the Equipment to and from the Event Location.
Delivery Fee means all fees payable to us for providing the Delivery Services and any additional costs or charges associated with delivery including parking.
Deposit means 50% of the total amount of the Hire Fees specified in the Quote or Booking.
Equipment means all the equipment and accessories we supply to the Hirer for the Hire Period specified on the Quote or Booking.
Event means the event indicated on the Booking or Quote at which the Equipment is to be used by the Hirer.
Event Location means the location of the Event at which the Equipment is to be used by the Hirer.
Force Majeure means any act of God, war, extreme weather, an unforeseeable event.
Hire Fees means all fees associated with hire of the Equipment, including Delivery Fees, Change Fee, Fair Wear and Tear Fee, Deposit and taxes.
Hire Period means the period during which the Equipment has left our warehouse and not in our possession, including during the Delivery Services, from the Delivery Date or Pickup Date until we have all of the Equipment back in our possession as set out in the Quote, Booking or otherwise agreed.
Hirer means the person, corporation, or firm hiring Equipment from us specified on the Quote or Booking.
Hirer’s Credit Card means the valid credit card number, expiry date of the Hirer and any other information required to charge the credit card.
Pickup Date means the date indicated on the Booking that the Hirer is to collect the Equipment from our warehouse.
Quote means the quote that we issue to the Hirer outlining the details of a prospective order including
Equipment, Hire Fees, Event, Event Location and Hire Period which is valid for 30 days.
